Court orders nationwide stay against WOTUS rule

WASHINGTON — The U.S. Court of Appeals for the Sixth Circuit has issued a nationwide stay, by a 2-1 vote, against enforcement of the Waters of the U.S. (WOTUS) rule.

The WOTUS rule, proposed by the Environmental Protection Agency and the U.S. Army Corps of Engineers, took effect Aug. 28 and was intended to clarify which bodies are water are covered by the Clean Water Act.

Several agricultural and industry groups have challenged the rule, including filing of a lawsuit that seeks to vacate. . .
